Social Posting Pro respects the intellectual property rights of others and expects its users to do the same. This policy explains how to notify us of copyright infringement under the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512, and how to respond if your content was removed.

1. Reporting copyright infringement

If you believe material stored on Social Posting Pro infringes your copyright, send a written notice to our Designated Copyright Agent containing all of the following, as required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of the copyright owner, or a person authorised to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material claimed to be infringing, with enough detail (such as a URL) for us to locate it.
  4. Your contact information — name, mailing address, telephone number and email address.
  5. A statement that you have a good-faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf.

3. What happens next

On receipt of a valid notice we will act expeditiously to remove or disable access to the material, and will make a reasonable attempt to notify the user who posted it, providing them with a copy of the notice.

4. Counter-notice

If your material was removed and you believe that was a mistake or misidentification, you may send a counter-notice to the Copyright Agent containing:

  1. Your physical or electronic signature.
  2. Identification of the material removed and the location where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Social Posting Pro may be found), and that you will accept service of process from the complainant.

If we receive a valid counter-notice, we may restore the material in 10–14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the activity.

5. Repeat infringers

In accordance with the DMCA and our Terms of Service, we will terminate the accounts of users we determine to be repeat infringers in appropriate circumstances.

6. Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and legal fees.
